Andrew Dickson White played a pivotal role in constructing the image of a necessary, and even violent, confrontation between religion and science that persists to this day. Though scholars have long acknowledged that his position is more complex, given that White claimed to be saving religion from theology, there has been no attempt to explore what this means in light of his overwhelming attack on existing religions. This essay draws attention to how White's role as (...) a historian was decisive in allowing him to posit a future for religion purified of dogma by science. It argues, furthermore, that this effort is better understood as religious innovation, rather than a plea for strictly secular science. In so doing it hopes to lay the foundation for a more fruitful historical treatment of White, and a range of other figures whose devotion to science has otherwise been difficult to grasp. (shrink)

In this paper, we examine the lawfulness of a proposal to provide elective ventilation to incompetent patients who are potential organ donors. Under the current legal framework, this depends on whether the best interests test could be satisfied. It might be argued that, because the Mental Capacity Act 2005 (UK) (and the common law) makes it clear that the best interests test is not confined to the patient's clinical interests, but extends to include the individual's own values, wishes and beliefs, (...) the proposal will be in the patient's best interests. We reject this claim. We argue that, as things currently stand, the proposal could not lawfully be justified as a blanket proposition by reference to the best interests test. Accordingly, a modification of the law would be necessary to render the proposal lawful. We conclude with a suggestion about how that could be achieved. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. The extended Church-Turing thesis posits that any computable function can be calculated efficiently by a probabilistic Turing machine. If this thesis held true, the global effort to build quantum computers might ultimately be unnecessary. Many contemporary philosophers of mind are concerned to defend a thesis called a posteriori physicalism. This thesis has two parts, one metaphysical, and the other epistemological. The metaphysical part of the thesis—the physicalist part—is the claim that the psychological nature of the actual world is wholly physical. The epistemological part of the thesis—the a posteriori part—is the claim that no a priori connection holds between psychological nature and physical nature. Despite its attractiveness, however, a familiar argument alleges that a posteriori (...) physicalism cannot be true. This argument is sometimes called the Property Dualism Argument Against Physicalism. In this paper, I consider Stephen White’s version of the Property Dualism Argument and argue that it fails. I distinguish two ways in which the argument’s crucial notion might be understood, and I argue that on neither way of understanding it is the Property Dualism Argument compelling. (shrink)

The paper proposes two ideas: (1) The wilderness preservation movement has failed to identify key elements involved in situations of environmental conflict. (2) The same movement seems unaware of its location within a tradition which is both elitist and Puritan. Holmes Rolston's recent work on the apparent conflict between feeding people and saving nature appears to exemplify the two points. With respect to point (1), Rolston's treatment fails to address the institutional and structural features which set the agenda for individual (...) human lives. The human ecology of environmental destruction cannot ignore the role of corporate actors such as banks, national governments, transnational corporations, trade unions and so on. These agents interact with each other in various ways and also have an internal structure – perhaps akin to Arthur Koestler's conception of the holarchy - which enables people working within them to avoid taking responsibility for policies that have damaging environmental consequences. As far as thesis (2) is concerned, Rolston's work shares common features with Arne Naess's deep ecology and Aldo Leopold's land ethic. All of these writers draw, perhaps unconsciously, on a tradition of sporting elitism associated with the Great White Hunter. One variety of this tradition combines elitism with a form of Puritanism. The Flats, a district near downtown Cleveland, was once was the vibrant heart of Midwestern industry and is now in the throes of change: Some of its warehouses and factories have been transformed into nightclubs and restaurants, while homes in adjacent neighborhoods have been replaced by mini-mansions. In Cleveland, photographer Andrew Borowiec documents the Flats today and evokes the way of life they once embodied. Given the rare opportunity to access one of Cleveland's vast steel mills before it was (...) modernized or destroyed, Borowiec employed his camera to explore the Flats and its monuments of American industry. His striking black and white images reveal the broken power and vulnerability of the once-mighty mill as well as its relation to the surrounding city and its neighborhoods. The commercial buildings, factories, warehouses, and iron bridges that sustained Cleveland's industrial pulse convey a quiet dignity in these compelling photographs, as do the modest frame houses that sheltered those who labored for decades in the Flats. As Clevelanders struggle to redefine themselves as citizens of a twenty-first-century corporate metropolis, the Flats stand as a haunting testament to a time when men worked with their hands and steel was indeed the backbone of our nation. Borowiec's compassionate but unflinchingly honest gaze challenges us to look both at and beyond the images of Cleveland and to meditate on our common history of loss and rebirth. (shrink)

A common objection against deflationism is that it cannot account for the fact that truth depends on reality. Consider the question ‘On what does the truth of the proposition that snow is white depend?’ An obvious answer is that it depends on whether snow is white. Now, consider what answer, if any, a deflationist can offer. The problem is as follows. A typical deflationary analysis of truth consists of biconditionals of the form ‘The proposition that p is true (...) iff p’. Such biconditionals tell us nothing about what the truth of the proposition that p might depend on. Therefore, it seems that a typical deflationist cannot give an answer. Since we know that an answer is available, this throws doubt over the adequacy of deflationism as an account of truth. Articulated here is a defence of deflationism against this objection. It is argued that although biconditionals of the sort mentioned do not explicitly state a dependency between truth and reality, they nevertheless convey one. The reason is that, given the context in which a deflationist invokes the biconditionals, such a dependency is implicated. A potential problem with this defence is that it leaves the deflationist still unable to give an account of what it is for truth to depend on reality. One might think that a deflationist can offer such an account by appealing to truthmaker theory but, it is argued below, truthmaker theory is unavailable to a deflationist. Instead, the deflationist should question the assumption that an account is available. (shrink)

In recent years, and especially in the wake of Barack Obama's reelection, projections that whites will soon become a minority have proliferated. In this essay, I will argue that such predictions are misleading at best, as they rest on questionable philosophical presuppositions, including the presupposition that racial concepts like ‘whiteness’ are static and unchanging rather than fluid and continually being reconstructed. If I am right about these fundamental inaccuracies, one must wonder why the myth of the white minority persists. (...) I will argue that by reenvisioning whites as a minority culture struggling against a hostile dominant group, and by promoting white solidarity as a response to a crisis, such predictions actually serve to defend and legitimize white supremacy. Sweeping denials of the story's capacity to accurately reflect the past are ever catalyzing equally misleading global affirmations. The impositionalists, such as theorist Hayden White, view historical narratives as imposing a falsifying narrative structure on the past, and conclude that narratives cannot be true. Plot-reifiers, such as Alasdair MacIntyre, David Carr, and Frederick Olafson, posit that the past is already narratively structured; historical plots are reified in order for there to be something in the world to which narrative structures (...) can correspond in being true. The antireferentialists such as JeanFrançois Lyotard and Roland Barthes deny that narrative histories even claim truth. Escaping this trilemma of theoretical interpretation involves accepting the idea that construction of a history does not entail its falsification. Historical narrative need to be allowed to function both figurally, in the sense of generating new discursive figures, and at the same time literally, in the sense of asking to be understood literally. Narratives need to be understood on their own terms, and not treated as an approximation to some foreign ideal. (shrink)

Publishers love titles that begin How or Why. Better still, How and Why, combining edification with utility. The target group is that overlap between the self-help audience and the idly curious—which is to say, most of us. And since emotions are very much about self-help and self-harm, they offer rich pickings in a burgeoning market. Flanagan's How to Do things with Emotions is a philosopher's take on moral emotions, the allusion to J. L. Austin's How to Do Things with Words (...) chiming with the self-help milieu. Reviewing cases, Flanagan points out that most scientific work in this field derives from experiments on psychology students, about as unrepresentative a slice of humanity as you could find. For Flanagan, they are too WEIRD (Western, Educated, Industrialized, Rich, Democratic) to tell us much about the non-weird majority. To learn to “do emotions better,” he argues, we have to look farther afield. Although the emotional lives of cultural others are surely different from those taking Psychology 101, at some functional level they might be similar. Work out the conceptual logic and practical rationale of culturally elaborated emotions—Minangkabau “shame,” Ifaluk “righteous anger,” American “road rage”—and there is scope for comparison. Indeed, anthropology has shown as much, and it is from anthropology that Flanagan takes his cues. To mention two famous cases, what can we learn about anger management from Utku igloo-dwellers and Ilongot headhunters? Mutually dependent for survival in their snowy isolation, the Utku cannot risk getting angry. (They mercilessly tease their children into learning the futility of anger.) In the jungles of Luzon, Ilongot youths cast away their anger in externally directed violence: headhunting as cathartic sport. We can think of parallels closer to home.Flanagan's vigorously argued book, a tour de force of its kind, is both an anatomizing of anger and shame—two moral emotions we tend to “do badly”—and a proposal to “change how we do these emotions.” Indignation is fine, but anger that is vengeful or “pain-passing,” rather than righteous, is irrational and socially harmful. Shame can be incapacitating and cruel (the undeserved burn of a Twitter pile-on). What we need is reflective anger directed at injustice and a “mature sense of shame” that reminds us of the social contract and stops us misbehaving.In its How-and-Why format, the book combines theory and practice, metaethics with moralism. Here is how a prof should do self-help. But if the diagnosis is well made, the remedy is hard to imagine. As Flanagan recognizes, moral sentiments and practices are embedded in intricate forms of life and not readily detachable. Anger Utku-style is not a transferable skill, nor are educative routines forged in social ecologies remote from our own. Lacking serviceable models, Flanagan falls back on the anthropological justification that knowledge of cultural diversity expands our sense of human possibility, of other roads taken. In a globalizing world, difference is its own reward. For me, an anthropologist, that maxim is enough. Yet difference bedevils comparison, jinxing the units, warping criteria. Most languages lack a word for emotion or an equivalent umbrella concept; nor do emotion words translate well across languages. Emotion may be an incoherent notion, or at best a heuristic.Flanagan's use of the WEIRD tag makes things a bit too easy. Does it cover farmhands and factory workers? Are we so democratic, anyway? More damagingly, a typological approach blurs the circumstances of family, community, and biography that define an emotional episode and shape its phenomenology, the way it is felt and experienced—what a violent outburst or fearful exit means in the context of a life. Take Joseph Conrad's Lord Jim, who flees a scene of failure and derails his life. It requires a long narrative to unravel the implications of his jumping ship and the paralyzing shame he experiences before the judgment of society. Or consider the scene in Anna Karenina in which the dignified and self-important Karenin, apprised of Anna's adulterous liaison, agonizes over the threat to his existence. To call his response jealousy would not scratch the surface. Characteristically for Tolstoy, the emotions go unnamed. Instead, we witness Karenin's fervid deliberations (emotions involve thoughts), vacillations (emotions have action tendencies), anguished calculations of impending scandal (emotions are appraisals), and bodily changes (emotions are cognized feelings). We shudder at the brutal metaphors through which he grasps his predicament and its cure: like rooting out a bad tooth, he decides. That welter of particularities escapes the theorist who needs clear-cut, comparable units, formulaic instances of jealousy or anger. But what are you left with if you omit the details? What would remain of Karenin's existential crisis?The novelist's privileged access to subjectivity is, of course, unavailable to the scientist, but the larger context of plot and character—a history of relations that gives emotional episodes their shape and power—has its analog in the ethnographic domain. Emotions are public as well as private events, their meanings and effects depending on a fit with social reality, a clash of perspectives. In thought and feeling, we are never really alone. All of which suggests that narrative, fictional or nonfictional, can capture the ongoing moment in a way that eludes other methods. If what we are after is living emotion, it is the movie, not the snapshot, that surely matters. No point in comparing “emotions” no one ever really experienced outside of an experiment.But there's the rub. In generalization—the goal of emotion theory—an emotion's social meaning, personal significance, pragmatic function, and narrative context get stripped out. All that makes it what it is! Even in doggedly empirical anthropology, detailed emotional episodes are rare (Jean Briggs's Utku ethnography Never in Anger, published in 1970, is still unsurpassed). Instead we get recollections and summary examples, lacking the constitutive detail, real-time evolutions, and consequences of the real thing. Yet these must serve for comparison, fodder for countless theoretical speculations. Are we at risk of analyzing faux emotions and building theories on cardboard constructions?An empty Arctic stage, a handful of characters, life simplified to survival: Briggs is a hard act to follow. Bare life does not make for basic emotions. On the white set, emotions prove hard to parse. That gruff hesitation, that flashing glint—are they tokens of anger? Empathy will not suffice. As Briggs shows, narrative context is all. And in our more cluttered emotional worlds, the value of backstory, interwoven biographies, and emotional plots is all the greater. Rights have become,in recent years, a significant concern of legal theorists, as well as of those involved in moral and political philosophy. This new book seeks to move a number of debates forward by developing the analysis of rights and focusing upon more general theoretical considerations relating to rights. The book is divided into five parts. The first includes an explanation of the part played by conceptual analysis within jurisprudence, while the second conducts a re-examination of Hohfeld’s analysis of rights. (...) This part deals with the arguments advanced by a number of modern theorists including Hart, White and MacCormick. The third part contains the author’s own framework for discussing rights, including examples drawn from tort, constitutional law and international law, together with an analysis of Unger’s theory of rights. Part four centres on the perceived conflict between Dworkin, Rawls and Nozick as the defenders of a rights approach, and Bentham as the champion of utilitarianism and concludes that neither deals with the fundamental concerns of morality on which their theories are based. The fifth part consists of a conclusion which reflects on the key themes and considers the role of rights within general theory. For students, particularly helpful features of the book are the overt consideration of jurisprudential methodology and the opportunity to examine a number of key theorists linked by their divergent views on the subject of rights. Asset egalitarianism is a new agenda but an old idea. At its root is the notion that every citizen should be able to have an individual property stake, and it has recently been revived in Britain and in the U.S. in a number of proposals aimed at countering the huge and growing inequality in the distribution of assets. Such asset egalitarianism is fed from many streams; it has a long history in civic republican thought, beginning with Thomas Paine and Thomas (...) Jefferson, but has also featured in the distributist theories of G.K. Chesterton and Hilaire Belloc; the guild socialism of G.D.H. Cole and the ethical socialism of R.H. Tawney; the market liberalism of the Ordo Liberals and some of the Austrian School, particularly F.A. Hayek; and more recently the market socialism of James Meade, A.B. Atkinson and Julian Le Grand, and the market egalitarianism of Michael Sherraden, Samuel Bowles, Herbert Gintis, Richard Freeman and Bruce Ackerman. There are also important links to the proponents of a citizens' income as a different approach to the welfare state (White 2002) as well as to the ideas of stakeholding (Dowding et al. 2003). This essay considers the growing interest in the methodology of jurisprudence in the context of a broader examination of the relationship between legal theory and the practice of law. Attention is drawn to the particular puzzles of how theory can both be independent of and yet inform practice, and how methodology can take a similar stance towards theory. Through a detailed analysis of the methodological positions adopted by Dworkin, Raz, and Coleman and Simchen, the conclusion is reached that methodology is (...) not a resource capable of offering an independent assessment of the merits of competing theories.Mainstream jurisprudential discussion is traced through the Hart-Dworkin debate to assumptions on the relationship between theory and practice initially adopted by Hart and sustained by subsequent contributors. The morbid condition of a prominent part of contemporary jurisprudence is identified with an unwarranted elevation of theory over practice. A more fruitful role for theory is suggested, in expounding the controversies met in the practice of law and considering the potential that exists for resolving them. It is suggested that this approach breaks down an artificial divide between descriptive and normative jurisprudence.A number of ancillary matters are discussed in the essay including: semantic approaches to legal theory, Dworkin’s semantic sting, the distinction between methodological and theoretical elements of Law’s Empire, Dickson on the ‘indirectly evaluative approach’, the position of Hart in his Postscript, and Raz’s split theory of legal reasoning and law. In this list, the pairs of opposites are in experience with a certain ultimate directness (...) of intuition, except in the case of the last pair. God and the World introduce the note of interpretation.—Alfred North Whitehead1Theistic finitism, the position that God is not omnipotent, is the most tenable solution to the problem of evil—but it also necessitates a slide toward immanence. Among the ranks of the finitists we find philosophers such as William James,2 process thinkers such as Whitehead and Charles Hartshorne,3 theological personalists such as Edgar Brightman (and, Rufus Burrow argues, his pupil Martin Luther King, Jr.),4 feminist disability theologians like Julia Watts Belser,5 and popular religion writers such as Harold Kushner.6 Like many others, Kushner found in finitism not an answer to an abstract theological puzzle, but an existentially necessary salve for the despair that nearly overtook him when his three year-old son was diagnosed with a terminal degenerative disease. No loving, all-knowing, all-powerful creator would ever allow such [End Page 70] a thing to happen, Kushner reasoned. If God is not all-powerful, then God need not be the author of our pain, but a friend who hurts with us as we bear it. Rather than sadistic puppeteer, a finite God becomes “the fellow-sufferer who understands.”7 As Jürgen Moltmann put it, “the one who cannot suffer cannot love either. So [God] is also a loveless being.”8 Or, as Dietrich Bonhoeffer reflected as he awaited execution in a Nazi concentration camp, “Only the suffering God can help.”9However, when one strips away divine omnipotence, one must also bid adieu either to God’s omniscience or creator-hood: for an omniscient creator, crafting the world with full knowledge of how everything would unfold, would be ipso facto omnipotent. We are left, then, with the following alternatives: we could posit a God who pressed the “create world” button not knowing what would happen (which seems irresponsible, calling into question God’s goodness)—as Tim Bayne puts it, “If future contingents fall outside the scope of God’s knowledge, then creation was a massive gamble.”10 We may share Albert Einstein’s famous distaste for a God who plays dice with the universe. The other alternative is that God’s knowledge and power are partial, that the Divine is merely one being/force among many. But if God is “just a stranger on the bus, trying to make his way home,”11 then in what sense can we say that God is God at all?This paper offers a construal of theistic finitism as a form of religious naturalism with an aesthetics of empathetic solidarity. To see God in this way, as Whitehead says, is to “introduce the note of interpretation.” And that note, I suggest, is a musical note, specifically a blues note.12 To call the loving [End Page 71] friendship we experience “God” is an aesthetic choice, an informed way of interpreting life in order to move through it with companionship, tenderness and care. A naturalistic religiosity, in Carol Wayne White’s phrasing, “can be a mode of reflecting on, experiencing, and envisioning one’s relationality with all that is.”13 In this way theology becomes, as Belser puts it, “a grammar of the imagination.”14 As a blues aesthetics of empathetic solidarity, theistic finitism may be considered a form of religious naturalism particularly well-suited to our present moment, mired as it is in cascading crises and careening into catastrophe.
